Federal prosecutors examined and studied Ashli Babbitt autopsy report and video clips on social media, investigated the officer and other eyewitnesses and gathered evidence from the scene.
The Justice Department said in a statement proclaiming the closure of its probe, “Based on that investigation, officials determined that there is insufficient evidence to support a criminal prosecution.”
The Wall Street Journal reported that investigators had determined that the officer, a lieutenant whom officials have not publicly identified, was acting as a last line of defense between rioters and members of Congress and should not be charged with any crimes.
Ashli Babbitt had served for more than a dozen years in the Air Force and Air National Guard and became a passionate supporter of former President Donald Trump.
Ashli Babbitt, an Air Force veteran, was one of five people who died on January 6, 2021, during the Capitol riots in Washington, D.C.
The events of that day shook the nation and left many people questioning the state of American democracy.
Babbitt was shot and killed by a U.S. Capitol Police officer as she attempted to climb through a cracked window of a barricaded door leading to the Speaker’s Lobby inside the Capitol.
At the time, police officers were evacuating members of Congress from the mob supporting Trump’s false declaration that the 2020 presidential election was stolen.
Babbitt’s death has been controversial, with some claiming that the police officer who shot her used excessive force.
On March 7, an Instagram post claimed that Babbitt was still alive. The post featured footage of a people and a woman wearing a red “Make America Great Again” hat.
The post was marked as part of Facebook’s attempt to combat false news and misinformation on its news feed.
Searching for the headlines that showed up scrolling at the bottom of the clip found that the clip of the soul in the video was from an October 1, 2022, speech by former President Donald Trump.
Video released by news organizations documented the shooting, and her widowed husband has talked to reporters about her death.
Officials with the U.S. Attorney’s Office for the District of Columbia’s Public Corruption and Department’s Internal Affairs Division reviewed video clip, police, and witness statements, physical proof from the crime scene of the gunfire, and the results of Babbitt’s autopsy as the portion of a Justice Department investigation into her demise.
After examining the evidence, the Justice Department announced on Wednesday, October 26, that the police officer who shot and killed Ashli Babbitt during the January 6 riot at the U.S. Capitol wouldn’t face federal criminal charges regarding her death.
In evaluating such cases, federal prosecutors must establish not only that an officer used excessive force but also that the officer willfully violated someone’s constitutional rights.
That high bar makes bringing federal charges against an officer difficult, and legal experts had predicted that any such case concerning Ms. Babbitt’s death was unlikely.
Ashli Babbitt’s death remains controversial, and conspiracy theories continue circulating on social media.
However, recent investigations by the Justice Department have ended that there is no evidence to support this.
